FerryPay Agreement
Contracting parties
Skyttel AS manages and operates the payment solution FerryPay on behalf
of the Norwegian Public Roads Administration.
This agreement (hereinafter referred to as
«the Agreement») is entered into between the user (hereinafter referred to
as «the Customer» and Skyttel AS (hereinafter referred to as «the
Company»). The Agreement regulates the Customer's use of the payment
solution and the Company's use of personal data to carry out the Customer's
payment of completed ferry journeys.
How the agreement works
The Agreement is created via website.
The Customer must register a credit/debit card and their name, address,
email address, phone number and registration number (licence plate number)
of the vehicle/vehicles they wish to add to the Agreement.
Ferry companies use photo and electronic recognition of the vehicle's
registration number to register the Customer's journeys on ferry
connections that use the payment solution. The information is then
forwarded to the Company for processing.
Once the ferry journey is completed, the Customer's credit/debit card registered with FerryPAY is charged a full-price ferry ticket. FerryPAY can be used on most of Norway's ferry connections; see the current connections here

Creation of agreement
The Customer can create an Agreement at any time and up to 48 hours after
making a ferry journey that the Customer wants to pay via credit/debit card
instead of invoice. Upon creating the Agreement, the Customer can choose to
enter an end date on the payment card/vehicle registration number. If
registering a credit card on the Agreement, a reservation of NOK 1 will be
made. The reservation is cancelled as soon as the card has been verified as
valid.
The Agreement automatically becomes invalid when the payment card expires.
The Customer will be notified of this via e-mail.
The Agreement is active until the contractual relationship is terminated by
the Customer via My Page on the Company’s website.
Vehicle identification
Photos by which the electronic system recognizes the vehicle registration
number are used to identify the vehicle. By accepting the terms and
conditions of the Agreement, the Customer gives the Company permission to
use the available visual and electronic identification of the vehicle. The
Agreement only applies to the vehicle/vehicles that the Customer has added
to the Agreement.
Privacy and data storage
The Company will process the Customer's personal data for the purpose
of collecting payment from the Customer for ferry journeys, for the
production of anonymous statistics, as a basis for information to the
Customer about ferry journeys charged to the Customer’s credit/debit
card, and for the implementation and administration of the Agreement
with the Customer. The Company uses the information the Customer
registered when creating the Agreement. The processing of personal data
is carried out according to the privacy legislation at the given time.
In accordance with the EU General Data Protection
Regulation (GDPR), the Company has entered into a data processor agreement
with the Norwegian Public Roads Administration. The Norwegian Public Roads
Administration is responsible for processing, while the Company is the data
processor for the payment solution.
Change of personal data
The Customer is responsible for ensuring that all information in the
Agreement is correct and that the credit/debit card is valid at all times.
In the event of an expired credit/debit card, the Agreement will be invalid
and a new payment card must be registered on the Agreement for the
Agreement to be valid again. The Customer will receive notification of this
to the email address registered on the Agreement. Changes to the
credit/debit card, address, email address, phone number and vehicle
registration number must immediately be changed by the Customer on My Page on the Company website. The Customer is responsible for the
vehicle's ferry charges until the Agreement is terminated or changes are
made on My Page.
Deletion of data
As Customer you have the right to know what data the Company has stored
about you and the right to request that your personal data be corrected,
disclosed or deleted from the Company’s systems. Deletion of data is on the
condition that this does not conflict with other legislation, such as the
Accounting Act. Accounting data such as transaction data in connection with
ferry journeys, ledgers, etc. must be stored in accordance with the
Accounting Act, which takes precedence over the EU General Data Protection
Regulation (GDPR).
Collaborators
Our partner for payment services is Nets, which is responsible for credit
management. The Agreement is under the condition that Nets confirms payment
responsibility for the Customer's payment card.
Responsibility for payment
If a charge towards the credit/debit card does not go through, an invoice
will be sent to the vehicle owner as registered in the Vehicle Register.
The Customer is responsible for all use of the Agreement. This
responsibility also includes other people’s use of the Customer's
agreement, including unauthorized use, unless unauthorized use is made
through theft of car or vehicle registration plate, or through forgery of
the vehicle registration plate. In such cases, the matter must be reported
to the police and a copy of the report sent to the Company (Skyttel AS).
After each ferry journey, the Customer will be able to see details such as
ferry connection, date, time and price on My Page on the Company’s
website. If the Customer believes a charge is incorrect, the Customer must
inform the Company of the matter.
Non-payment fee
If the Company does not receive payment for a ferry journey, an invoice for
the outstanding amount and invoice fee will be sent to the vehicle owner as
registered in the Vehicle Register. In the event of non-payment of the
invoice, a reminder fee will be added at the rate applicable at the time.
Duty of confidentiality and disclosure of personal information
The Company has a duty of confidentiality regarding the Customer's use of
the payment solution. When the Company is legally obliged by a court,
prosecuting authority or other public authority, it may be relevant to
disclose personal data.
Changes to terms and conditions
Agreements, terms and conditions may be changed or terminated as a result
of public directives, regulations or other matters for which the Company is
not responsible. Significant changes in the terms and conditions of the
Agreement will be notified to the Customer in advance. The Company
preconditions that the terms and conditions of the Agreement are accepted
at all times, including after updates, unless the Agreement is terminated
by one of the contracting parties.
The Agreement can be transferred by the Company to a different company.
Notification will be given to the Customer 14 days before the Company
transfers the Agreement.
